Board Minutes - November 9, 2010

VILLAGE OF MURRAY, NEBRASKA

      November 9, 2010 

      The Murray, Nebraska Board of Trustees met in regular session on Tuesday, November 9, 2010 at 7:00 pm in the Murray Municipal Building.  Present:  Trustees: Bill Johnson, Debbie Newhouse, George Blessing, Stan Flak, Shelley Lesac; Village Clerk Eileen Murdoch; attending: guests.

      Notice of the meeting was given in advance thereof by posting in (3) three public places as shown by the certificate attached to these minutes.  Notice of the meeting was simultaneously given to the Chairperson and all members of the Board of Trustees.  Their acknowledgement of receipt of notice and agenda is attached to these minutes.  All proceedings thereafter were taken while the convened meeting was open to the attendance of the public.

      Chairperson Lesac called the meeting to order at 7:00 PM and informed the audience of the location of the open meetings act poster. 

      Motion by Johnson, seconded by Newhouse to approve the minutes of the October 12, 2010 regular meeting; ayes:  Johnson, Newhouse, Blessing, Flak, Lesac; motion carried.

      Motion by Johnson, seconded by Flak to acknowledge receipt of the Treasurer's report and the minutes from the October 5, 2010 Planning Commission meeting, ayes: Johnson, Newhouse, Blessing, Flak, Lesac; motion carried.

      Motion by Newhouse, seconded by Johnson to approve claims as revised; ayes:  Johnson, Newhouse, Blessing, Flak, Lesac; motion carried.

      Maintenance Report. 

      Kyle Steckler, Conestoga Athletic Director and softball coach, improvements to Young Park ball field. 

      Motion by Blessing, seconded by Newhouse to open the hearing on the variance request for 2.14 acre subdivide for Brian and Pam Caba; ayes:  Johnson, Newhouse, Blessing, Flak, Lesac; motion carried.  Motion by Flak, seconded by Blessing to close the hearing; ayes:  Johnson, Newhouse, Blessing, Flak, Lesac; motion carried.

      Motion by Johnson, seconded by Newhouse to approve the variance request; ayes:  Johnson, Newhouse, Blessing, Flak, Lesac; motion carried.

      Hearing for Special Use Permit was passed over, no one was in attendance.

      Motion by Johnson, seconded by Flak to open the hearing for the preliminary replat of Lindean Estates, Dave and Jenny Cook.  Motion by Flak, seconded by Johnson to close the hearing for the preliminary plat; ayes: Johnson, Newhouse, Blessing, Flak, Lesac, motion carried.

      Motion by Johnson, seconded by Flak to approve the preliminary plat for Dave and Jenny Cook; ayes:  Johnson, Newhouse, Blessing, Flak, Lesac, motion carried.

      Chairperson Lesac introduced and read by title Ordinance #505 AN ORDINANCE AMENDING SUBPARAGRAPH (D) OF TITLE XV, CHAPTER 151, SECTION 151.10 AND 151.20 FO THE CODE OF ORDINANCES OF THE VILLAGE OF MURRAY, CASS COUNTY, NEBRASKA; TO PROVIDE FOR THE REPEAL OF CONFLICTING ORDINANCES OR SECTIONS ; AND TO PROVIDE FOR AN EFFECTIVE DATE.  Trustee Blessing motioned, seconded by Trustee Newhouse to suspend the three required statutory readings of Ordinance #505; ayes:  Johnson, Newhouse, Blessing, Flak, Lesac; motion carried.  Motion by Blessing, seconded by Flak to adopt, post and publish in pamphlet form Ordinance #505; ayes:  Johnson, Newhouse, Blessing, Flak, Lesac; motion carried.

      Approve new water contract with Cass County Rural Water District #1 (CCRW).  Motion by Newhouse, seconded by Johnson to approve the new water contract with Cass County Rural Water District; ayes:  Johnson, Newhouse, Blessing, Flak, Lesac, motion carried.

      Motion by Johnson, seconded by Newhouse to approve invoice for Kerns Excavating for $14,825.00 for the Davis and Main Street project; ayes:  Johnson, Newhouse, Blessing, Flak, Lesac, motion carried.

      Discuss creation of Park Foundation. 

      Motion by Newhouse, seconded by Blessing to enter executive session at 8:15 PM to discuss employee reviews and salaries; ayes:  Johnson, Newhouse, Blessing, Flak, Lesac, motion carried.

      Motion by Blessing, seconded by Flak to exit executive session at 8:50 PM; ayes: Johnson, Newhouse, Blessing, Flak, Lesac, motion carried.

      Motion by Newhouse, seconded by Johnson to make the changes discussed in executive session to set salaries; ayes:  Johnson, Newhouse, Blessing, Flak, Lesac, motion carried.

      Motion by Newhouse, seconded by Flak to adjourn the meeting at 8:58 PM; ayes:  Johnson, Newhouse, Blessing, Flak, Lesac; motion carried.

      I, the undersigned Village Clerk of the Village of Murray, Nebraska, hereby certify that the foregoing is a true and correct copy of proceedings had and done by the Chairperson and the Board of Trustees of the Village of Murray to the best of my knowledge; that the agenda was kept continually current and available for public inspection at the office of the Village Clerk; that the minutes were in written form and available for public inspection within (10) working days and prior to the next convened meeting of said body; the minutes are published in summary form, upon request a complete copy is available at the Village Office.
