The Murray, Nebraska Board of Trustees met in regular session on Wednesday, May 11, 2022, at 7:00 pm in the Murray Municipal Building. Present: Trustees: Jeff Anderson, George Blessing, Stan Flak, Don Strong, Josh Kucera; Village Clerk Shelli Hayes, Maintenance Operator Jerome Speck, and guests.

Notice of the meeting was given in advance thereof by posting in (3) three public places on April 26, 2022, as shown by the certificate attached to these minutes. Notice of the meeting was simultaneously given to the Chairman and all members of the Board of Trustees. Their acknowledgement of receipt of notice and agenda is attached to these minutes. All proceedings thereafter were taken while the convened meeting was open to the attendance of the public.

Chairman Anderson called the meeting to order at 7:00 PM, and roll call was conducted. Anderson informed the audience of the location of the Open Meetings Act poster.

Chairman Anderson laid over the matter to next month’s meeting.

Motion by Strong, seconded by Flak to approve Special Designated License (SDL) for Murray Freedom Festival for Dance/Beer Garden Fundraiser, June 11, 2022, 2:00 pm to 10:30 pm; ayes: Flak, Strong, Kucera, Anderson; abstain: Blessing; motion carried.

Chairman Anderson opened a public hearing at 7:36 pm for the purpose of hearing support, opposition, criticism, suggestions, or observations of the public regarding Ordinance No. 667 AN ORDINANCE OF THE VILLAGE OF MURRAY, NEBRASKA, to Amend Article 8, Accessory Uses and Supplemental Regulations, Section 8.1, Accessory Building/Garages/Carports; To Enact Article 8, Accessory Uses and Supplemental Regulations, Section 8.11, Storage/Shipping Containers. Following public comment, Chairman Anderson closed the public hearing at 7:50 pm. Chairman Anderson laid over the matter until next month’s meeting.

Chairman Anderson introduced and read by title Ordinance No. 668 AN ORDINANCE ADOPTED BY THE VILLAGE OF MURRAY, CASS COUNTY NEBRASKA #668 Animal Regulations, Sections 58 and 99, Impounding; Notice, and Penalty for Violations of the Ordinance. Motion by Blessing, seconded by Strong to suspend the three required statutory readings of Ordinance #668; ayes: Blessing, Flak, Strong, Kucera, Anderson; motion carried. Motion by Strong, seconded by Kucera to adopt, post, and publish in pamphlet form Ordinance #668; ayes: Blessing, Flak, Strong, Kucera, Anderson; motion carried.

Motion by Blessing, seconded by Strong to approve Resolution 22-02, Purchase Authority; ayes: Blessing, Flak, Strong, Kucera, Anderson; motion carried.

Motion by Flak, seconded by Strong to approve Resolution 22-03, Bulk Water Rate; ayes: Flak, Strong, Kucera, Anderson; nays: Blessing; motion carried.

Motion by Blessing, seconded by Strong to approve bid from Immense Impact, LLC, for website set-up and subscription for $914.95 for the first year, with an anticipated annual subscription cost of $617.40; ayes: Blessing, Flak, Strong, Kucera, Anderson; motion carried.

Motion by Kucera, seconded by Blessing to approve bid from D.J. Gongol & Associates Inc. for a 3-hp standby booster pump including expansion joints and freight for $4,310.00; ayes: Blessing,Flak, Strong, Kucera, Anderson; motion carried.

Chairman Anderson laid over the matter of the bid from D.J. Gongol & Associates, Inc. for a booster pump and two expansion joints, until next month’s meeting to obtain a second bid.

Motion by Blessing, seconded by Kucera to approve the bid from Wessels Trucking for 3/4 inch rock/gravel at $25.50 per ton for village parking lot, 160’ x 96’, 106 N Park Ave; ayes: Blessing, Flak,Strong, Kucera, Anderson; motion carried.

Motion by Anderson, seconded by Strong to enter closed session for the protection of the public interest for the purposes of discussing current litigation entitled Jeremy Masid, an individual, and Professional Heating and Air Conditioning, Inc., a Nebraska Corporation v. Village of Murray, Case No. CI21-98; ayes: Blessing, Flak, Strong, Kucera, Anderson; motion carried.

Chairman Anderson then restated that the Board of Trustees would enter closed session at 7:45 pm for the protection of the public interest for the purposes of discussing current litigation entitled Jeremy Masid, an individual, and Professional Heating and Air Conditioning, Inc., a Nebraska Corporation v. Village of Murray, Case No. CI21-98.

Motion by Anderson, seconded by Blessing to reconvene in open session at 8:15 pm; ayes: Blessing, Flak, Strong, Kucera, Anderson; motion carried.

Motion by Strong, seconded by Kucera to adopt amended employee personnel handbook dated March 8, 2022; ayes: Strong, Kucera, Anderson; nays: Flak; abstain: Blessing; motion carried.

Motion by Flak, seconded by Strong to approve State of Nebraska Department of Transportation Agreement regarding Lighting Relocation, Project No. STP-1-7(107), Murray-US-34 and US-75, Control No. 22467A; ayes: Blessing, Flak, Strong, Kucera, Anderson; motion carried.

Motion by Blessing, seconded by Strong to approve State of Nebraska Department of Transportation Agreement regarding Engineering and Construction Services, Project No. STP-1-7(107), Murray-US-34 and US-75, Control No. 22467A; ayes: Blessing, Flak, Strong, Kucera, Anderson; motion carried.

Motion by Blessing, seconded by Flak to authorize village staff to work with JEO Consulting Group to complete the Security Grant Application for Water System & Sewer System GIS Mapping, and approve the bid for $14,500.00; specifically a $10,000.00 security grant plus $4,500.00 from Village Cash Funds utilizing remaining ARPA funds; ayes: Blessing, Flak, Strong, Kucera, Anderson;
motion carried.
