      The Murray, Nebraska Board of Trustees met in regular session on Tuesday, December 14, 2010 at 7:00 pm in the Murray Municipal Building.  Present:  Trustees: Bill Johnson, George Blessing, Stan Flak, Shelley Lesac; Absent:  Debbie Newhouse; Village Clerk Eileen Murdoch; attending: guests.

      Notice of the meeting was given in advance thereof by posting in (3) three public places as shown by the certificate attached to these minutes.  Notice of the meeting was simultaneously given to the Chairperson and all members of the Board of Trustees.  Their acknowledgement of receipt of notice and agenda is attached to these minutes.  All proceedings thereafter were taken while the convened meeting was open to the attendance of the public.

      Chairperson Lesac called the meeting to order at 7:00 PM and informed the audience of the location of the open meetings act poster.

      Steven Parr, JEO Consulting, discuss and review 1-6 year street plan. 

      Motion by Flak, seconded by Johnson to adopt Resolution 10-05 to set salaries and other benefits; ayes:  Johnson, Blessing, Flak, Lesac; Absent:  Newhouse, motion carried.

      Motion by Flak, seconded by Johnson to adopt Resolution 10-06 whereas the Rural Water District No. 1, Cass County, Nebraska, has tendered to the Village of Murray, Nebraska, a water purchase agreement allowing for the purchase of water necessary for Murray's residents; ayes:  Johnson, Blessing, Flak, Lesac; Absent:  Newhouse, motion carried.

      Discuss submission of NDEQ grant request for purchase of tire derived products.  Chairperson Lesac said it would be her recommendation not to do it right now, the Board agreed.

      Update and status of trailer court nuisance.  Motion by Johnson, seconded by Flak to start the nuisance process on the trailer court for the clean-up; ayes:  Johnson, Blessing, Flak, Lesac; Absent:  Newhouse, motion carried.

      Update on creation of Park Foundation. 

      Discuss possible dump/sander truck purchase.  Motion by Blessing, seconded by Flak to authorize Konfrst to bring the truck here over the weekend so the Board can take a look at it and make some sort of decision on what it's worth and what we want to pay for it; ayes:  Johnson, Blessing, Flak, Lesac; Absent:  Newhouse, motion carried.

        Pro- Tem Johnson called the reorganization of the board to order at 8:04 PM.  Shelley Lesac and Michael Gillott read the Oath of Office, Debbie Newhouse was Absent.  Motion by Johnson, seconded by Blessing to nominate Shelley Lesac for Chairperson; ayes:  Johnson, Blessing, Gillott; Abstain:  Lesac, motion carried.

      Motion by Lesac, seconded by Blessing to nominate Bill Johnson as Pro-tem; ayes:  Blessing, Gillott, Lesac, Abstain:  Johnson, motion carried.

Sheriff, Shelley Lesac,  Physician position open; ayes:  Johnson, Blessing, Gillott, Lesac, motion carried.

      Chairperson Lesac introduced and read by title Ordinance #505 AN ORDINANCE AMENDING SUBPARAGRAPH (D) OF TITLE XV, CHAPTER 151, SECTION 151.10 AND 151.20 FO THE CODE OF ORDINANCES OF THE VILLAGE OF MURRAY, CASS COUNTY, NEBRASKA; TO PROVIDE FOR THE REPEAL OF CONFLICTING ORDINANCES OR SECTIONS ; AND TO PROVIDE FOR AN EFFECTIVE DATE.  Trustee Blessing motioned, seconded by Trustee Newhouse to suspend the three required statutory readings of Ordinance #505; ayes:  Johnson, Newhouse, Blessing, Flak, Lesac; motion carried.  Motion by Blessing, seconded by Flak to adopt, post and publish in pamphlet form Ordinance #505; ayes:  Johnson, Newhouse, Blessing, Flak, Lesac; motion carried.

Motion by Newhouse, seconded by Flak to open the budget hearing at 7:08 PM; ayes: Johnson, Newhouse, Flak, Lesac, Absent: Blessing, motion carried. CPA Melinda Clarke was in attendance and gave a brief rundown of the budget and any changes done for this year. Clarke did point out that the tax request was smaller this year, because of a change in evaluations. She went over the restricted funds section and told the board they need to look at trying to spend some of this money. Motion by Flak, seconded by Johnson to close the budget hearing at 7:15 PM; ayes: Johnson, Newhouse, Flak, Lesac; Absent: Blessing, motion carried.

Chairperson Lesac introduced and read by title Ordinance #504 AN ORDINANCE ADOPTED BY THE VILLAGE OF MURRAY, CASS COUNTY, NEBRASKA TO ADOPT THE BUDGET STATEMENT TO BE TERMED THE ANNUAL APPROPRIATION BILL; TO APPROPRIATE SUMS FOR NECESSARY EXPENSES AND LIABILITIES; TO PROVIDE FOR AN EFFECTIVE DATE. Trustee Newhouse motioned, seconded by Trustee Johnson to suspend the three required statutory readings of Ordinance #504; ayes: Johnson, Newhouse, Flak, Lesac; Absent: Blessing, motion carried. Request for handicapped space for CJ's Beauty Salon. The Board decided to table this item until CJ could attend a meeting.

Review Berner letter. Motion by Newhouse, seconded by Flak to approve the lien for $767.00 on 811 E. Main St.; ayes: Johnson, Newhouse, Blessing, Flak, Lesac; motion carried.
