VILLAGE OF MURRAY, NEBRASKA

      March 8, 2011 

      The Murray, Nebraska Board of Trustees met in regular session on Tuesday, March 8, 2011 at 7:00 pm in the Murray Municipal Building.  Present:  Trustees: Bill Johnson, Debbie Newhouse,  Mike Gillott, Shelley Lesac; Absent:  George Blessing, Village Clerk Eileen Murdoch; attending: guests.

      Notice of the meeting was given in advance thereof by posting in (3) three public places as shown by the certificate attached to these minutes.  Notice of the meeting was simultaneously given to the Chairperson and all members of the Board of Trustees.  Their acknowledgement of receipt of notice and agenda is attached to these minutes.  All proceedings thereafter were taken while the convened meeting was open to the attendance of the public.

      Chairperson Lesac called the meeting to order at 7:00 PM and informed the audience of the location of the open meetings act poster.

      Motion by Newhouse, seconded by Johnson to approve the minutes of the February 8, 2011 regular meeting; ayes:  Johnson, Newhouse, Gillott, Lesac; Absent:  Blessing, motion carried.

      Motion by Johnson, seconded by Newhouse to acknowledge receipt of the Treasurer's report, ayes: Johnson, Newhouse, Gillott, Lesac; Absent:  Blessing, motion carried.

      Motion by Johnson, seconded by Newhouse to approve claims as revised; ayes:  Johnson, Newhouse, Gillott, Lesac; Absent:  Blessing, motion carried.

      Trustee Blessing entered the meeting at 7:08 PM

      Maintenance Report. 

      Motion by Blessing, seconded by Johnson to open the hearing for the Liquor License for Dawn Vlcek d/b/a Fire House Grille; ayes:  Johnson, Newhouse, Blessing, Gillott, Lesac, motion carried.  Vlcek was not in attendance. There was some discussion on when it changed possession and who she was.  Motion by Blessing, seconded by Johnson to close the hearing; ayes:  Johnson, Newhouse, Blessing, Gillott, Lesac, motion carried.  Motion by Johnson, seconded by Blessing to approve the Liquor License application; ayes:  Johnson, Newhouse, Blessing Gillott, Lesac, motion carried.

      Chairperson Lesac introduced and read by title Ordinance #506 through #513 AN ORDINANCE ADOPTED BY THE VILLAGE OF MURRAY, CASS COUNTY, NEBRASKA #506 - Animals, to make pitting unlawful; #507 - Animals, to make unlawful the abandonment, neglect, or mistreatment; #508 - Alcoholic Liquor to adopt state law definitions; #509 - Alcoholic Liquor, to establish licensee requirements; #510 - Alcoholic Liquor , to establish municipal powers regarding licensing; #511 - Alcoholic Liquor, to regulate location; #512 - Alcoholic Liquor to regulate the hours of sale; #513 - Alcoholic Liquor,  provide for catering licenses  Trustee Blessing  motioned, seconded by Trustee Johnson to suspend the three required statutory readings of Ordinance #506 through #513; ayes:  Johnson, Newhouse, Blessing, Gillott, Lesac, motion carried.  Motion by Johnson, seconded by Blessing to adopt, post and publish in pamphlet form Ordinance #506 through #513; ayes:  Johnson, Newhouse, Blessing, Gillott, Lesac, motion carried.

      Resolution 11-02, Establish a Murray Park Foundation.  Motion by Newhouse, seconded by Johnson to adopt Resolution 11-02; ayes:  Johnson, Newhouse, Blessing, Gillott, Lesac, motion carried.

      Discuss possible vacant building ordinance. 

      Berner nuisance, updates. 

      Approve clean-up weekend.  Motion by Newhouse, seconded by Blessing to approve clean-up weekend for June 4-5; ayes:  Johnson, Newhouse, Blessing, Gillott, Lesac, motion carried.

      Motion by Newhouse, seconded by Blessing to adjourn the meeting at 7:52 PM; ayes:  Johnson, Newhouse, Blessing, Gillott, Lesac, motion carried.

      Review and discuss grace period for pet licenses.  Motion by Newhouse, seconded by Johnson to change the grace period for licensing from January 1 to March 15; ayes:  Johnson, Newhouse, Blessing, Gillott, Lesac, motion carried.

      Berner nuisance, update. 

      Update on creation of Park Foundation. 

      Approve lien in the amount of $216.27 for 109 N. Latta, and $71.80 for 212 E. Campbell St., Estate of Vicki Brundieck. Motion by Newhouse, seconded by Johnson to approve the liens for $216.27 for 109 N. Latta and $71.80 for 212 E. Campbell St.; ayes:  Johnson, Newhouse, Blessing, Gillott, Lesac, motion carried.

      Trustee Newhouse read the Oath of Office.

      Motion by Johnson, seconded by Newhouse to approve the minutes of the December 14, 2010 regular meeting; ayes:  Johnson, Newhouse, Lesac; Absent:  Blessing, Gillott, motion carried.

      Motion by Newhouse, seconded by Johnson to acknowledge receipt of the Treasurer's report, and the minutes from the December 7, 2010 Planning Commission meeting, ayes: Johnson, Newhouse, Lesac; Absent:  Blessing, Gillott, motion carried.

      Motion by Johnson, seconded by Newhouse to approve claims as revised; ayes:  Johnson, Newhouse, Lesac; Absent: Blessing, Gillott, motion carried.

      Trustee Blessing entered the meeting at 7:04 PM

      Maintenance Report. 

      Hearing for final plat for Brian and Pam Caba.  The final plat was not ready for the meeting, so this item will be carried over to the February meeting.

      Review 1-6 year Street Plan. 

      Update on creation of park foundation.  Clerk Murdoch said she spoke with attorney Morten today and relayed the information to the Board, Murdoch said that Morten informed her that the town could create a park foundation; he would just need to make an Ordinance for it and the Board would need to pass it.  Murdoch said Morten would have one ready for February's meeting.

      Transfer $62,309.74 from general fund to park fund to zero it out.  Motion by Johnson, seconded by Newhouse to transfer $62,309.74 from the general fund to the park fund to zero it out; ayes:  Johnson, Blessing, Newhouse, Lesac, motion carried.

      There was an executive session planned, but Chairperson Lesac stated that it did not need to be an executive session; she just wanted to discuss and clarify what exactly the village is looking for as far as a dump truck. 

      Trustee Gillott entered the meeting at 7:18 PM

      Lesac continued saying her thought on the whole thing is what we really need is a truck to put the sander in, it would be much better and more versatile to buy a one ton four wheel drive vehicle that you can use every day, which is her thought. Trustee Newhouse agreed that that would be much more usable for us.  Chairperson Lesac went on to say she just wanted to get a general consensus from the board that this is what we want to do.  The Board agreed this was the direction to go.  Chairperson Lesac said she would pull something together and have it for the next meeting so maybe it can get approved and we can get it out.

      Motion by Johnson, seconded by Blessing to adjourn the meeting at 7:29 PM; ayes:  Johnson, Newhouse, Blessing, Gillott, Lesac, motion carried.
