The Murray, Nebraska Board of Trustees met in regular session on Tuesday, December 11, 2012 at 7:00 pm in the Murray Municipal Building.  Present:  Trustees: Bill Johnson, Debbie Newhouse, Mike Gillott, Shelley Lesac; Absent:  George Blessing; Village Clerk Eileen Murdoch; attending: guests. 
 
Notice of the meeting was given in advance thereof by posting in (3) three public places as shown by the certificate attached to these minutes.  Notice of the meeting was simultaneously given to the Chairperson and all members of the Board of Trustees.  Their acknowledgement of receipt of notice and agenda is attached to these minutes.  All proceedings thereafter were taken while the convened meeting was open to the attendance of the public. 
 
Chairperson Lesac called the meeting to order at 7:00 PM and informed the audience of the location of the open meetings act poster. 
 
Motion by Johnson seconded by Newhouse to approve the minutes of the November 13, 2012, regular meeting; ayes:  Johnson, Newhouse, Gillott, Lesac; Absent:  Blessing, motion carried. 
 
Motion by Johnson, seconded by Newhouse to acknowledge receipt of the Treasurer’s report; ayes: Johnson, Newhouse, Gillott, Lesac; Absent:  Blessing, motion carried. 
 
Motion by Johnson, seconded by Newhouse to approve claims as revised; ayes:  Johnson, Newhouse, Gillott, Lesac; Absent: Blessing, motion carried. 
 
Maintenance Report.  
 
Review Special Use Permit, All American Recycling 60 day review.  Motion by Johnson, seconded by Newhouse to approve the special use permit for All American recycling for 5 years; ayes:  Johnson, Newhouse, Gillott, Lesac; Absent:  Blessing, motion carried. 
 
Trustee Blessing entered the meeting at 7:05 PM. 
 
Review/discuss potential truck/blade/sander purchase.  
 
Discuss and set fees for animal shelter/kennel. 
  
Pro- Tem Johnson called the reorganization of the board to order at 7:42 PM.  Trustees Blessing and Johnson read the Oath of Office.  Motion by Blessing, seconded by Gillott to nominate Bill Johnson for Chairperson; Motion by Newhouse, seconded by Johnson to nominate Shelley Lesac as Chairperson; There was discussion with the attorney on the voting process; it was decided to do a vote by ballot.  Clerk Murdoch collected the ballots, two votes for Bill Johnson, three votes for Shelley Lesac; Lesac is voted in as Chairperson. 
 
Motion by Blessing, seconded by Newhouse to nominate Bill Johnson as Pro-tem; ayes:  Johnson, Newhouse, Blessing, Gillott, Lesac, motion carried. 
 
Motion by Johnson, seconded by Gillott for the following appointments for 2012, Larry Morton, attorney; Eileen Murdoch, clerk/treasurer; JEO Village Engineer; JEO, Street Superintendent – Steven Parr; Debbie Newhouse, animal control officer; Debbie Newhouse, Water Commissioner; George Blessing, Street Commissioner; Michael Gillott, Park Commissioner; Rudy Lesac, Emergency Management Coordinator/Contact; Board of Health:  Cass Co. Sheriff, Shelley Lesac,  Physician position open; ayes:  Johnson, Newhouse, Blessing, Gillott, Lesac, motion carried. 
 
Motion by Blessing, seconded by Newhouse to adjourn the meeting at7:55 PM; ayes:  Johnson, Newhouse, Blessing, Gillott; Absent: Lesac, motion carried.

Pro-Tem Johnson introduced and read by title Ordinance #530 AN ORDINANCE OF THE VILLAGE OF MURRAY TO ADD A SECTION TO THE MUNICIPAL CODE OF THE VILLAGE OF MURRAY TO IMPLEMENT A SALES AND USE TAX; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH; DIRECTING THE PUBLICATION OF THIS ORDINANCE; AND PRESCRIBING A TIME WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT.  Motion by Blessing, seconded by Gillott to suspend the three required statutory readings of Ordinance #530; ayes:  Johnson, Newhouse, Blessing, Gillott, Absent:  Lesac, motion carried.  Motion by Blessing, seconded by Newhouse to adopt, post and publish in pamphlet form Ordinance #530; ayes:  Johnson, Newhouse, Blessing, Gillott; Absent: Lesac, motion carried.

Steven Parr, JEO, review 1-6 year street plan. 

Fred Erikson, install temporary wire for radio club activity the last week in November through the December 3.  Motion by Blessing, seconded by Newhouse to allow Erikson to string the temporary wire from Murray water tower; ayes:  Johnson, Newhouse, Blessing, Gillott, Lesac; motion carried.

Review meter reading handheld pricing.  Motion by Newhouse, seconded by Blessing to purchase the new handheld and gun for meter reading; ayes:  Johnson, Newhouse, Blessing, Gillott, Lesac; motion carried.

LARM Participation Discount, adopt Resolution 12-07.   Motion by Newhouse, seconded by Blessing to adopt Resolution 12-07 Renewal Resolution with LARM for the two year commitment and 4% discount; ayes:  Johnson, Newhouse, Blessing, Gillott, Lesac; motion carried.

 Approve homecoming banner and flags for Simpson, on or about September 29, 2012.    Motion by Blessing, seconded by Johnson to approve the homecoming banner and flags for Judy Simpson; ayes:  Johnson, Newhouse, Blessing, Gillott, Lesac; motion carried. 

 Motion by Johnson, seconded by Newhouse to approve liens for $268.00 for mowing at 106 E. Main Street and $72.10 for unpaid utilities at 121 E. Main St.; ayes:  Johnson, Newhouse, Blessing, Gillott, Lesac; motion carried. 

 Discuss Planning Commission membership.  

 Motion by Blessing, seconded by Johnson to enter executive session at 7:31 PM; ayes:  Johnson, Newhouse, Blessing, Gillott, Lesac, motion carried. 

 Motion by Johnson, seconded by Newhouse to exit executive session at 7:42 PM; ayes:  Johnson, Newhouse, Blessing, Gillott, Lesac, motion carried. 

 Motion by Johnson, seconded by Newhouse to have the salaries of Village of Murray employees to remain the same for the 2012-2013 fiscal year; ayes:  Johnson, Newhouse, Blessing, Gillott, Lesac; motion carried.
