The Murray, Nebraska Board of Trustees met in regular session on Tuesday, April 9,  2013, at 7:00 pm in the Murray Municipal Building.  Present:  Trustees: George Blessing, Debbie Newhouse, Shelley Lesac; Absent: Bill Johnson, Mike Gillott; Village Clerk Eileen Murdoch; attending: guests.

Notice of the meeting was given in advance thereof by posting in (3) three public places as shown by the certificate attached to these minutes.  Notice of the meeting was simultaneously given to the Chairperson and all members of the Board of Trustees.  Their acknowledgement of receipt of notice and agenda is attached to these minutes.  All proceedings thereafter were taken while the convened meeting was open to the attendance of the public.

Chairperson Lesac called the meeting to order at 7:00 PM and informed the audience of the location of the open meetings act poster.

Motion by Newhouse seconded by Blessing to approve the minutes of the March 12, 2013, regular meeting; ayes:  Newhouse, Blessing, Lesac; Absent: Johnson, Gillott, motion carried.

Motion by Blessing, seconded by Newhouse to acknowledge receipt of the Treasurer’s report; ayes: Newhouse, Blessing, Lesac; Absent:  Johnson, Gillott, motion carried.

Motion by Newhouse, seconded by Blessing to approve claims as revised; ayes: Newhouse, Blessing, Lesac; Absent: Johnson, Gillott, motion carried.

Maintenance Report. 

Approve building permit, pole building, Mike and Lisa Lentsch, 10143 12th St., Murray .  Motion by Blessing, seconded by Newhouse to approve the building permit; ayes:  Newhouse, Blessing, Lesac; Absent:  Johnson, Gillott, motion carried.

Approve Field Days for the Plattsmouth Amateur Radio club for June 22nd, and 23rd.  Motion by Newhouse, seconded by Blessing to approve use of Young Park for the Field Days; ayes:  Newhouse, Blessing, Lesac; Absent:  Johnson, Gillott, motion carried.

Discuss condition of trailer court.  Motion by Newhouse, seconded by Blessing to determine lots 3, 4, 6 and 7 a nuisance due to their decrepit state, broken windows, not anchored down, open to the public and elements; ayes: Newhouse, Blessing, Lesac; Absent:  Johnson, Gillott, motion carried.

Motion by Blessing, seconded by Newhouse to adjourn the meeting at 7:16 PM; ayes:   Newhouse, Blessing, Lesac; Absent: Johnson, Gillott, motion carried.

Motion by Blessing, seconded by Johnson to open the hearing for the 1-6 year Street Plan, ayes:  Johnson, Newhouse, Blessing, Lesac; Absent:  Gillott, motion carried.  Motion by Johnson, seconded by Blessing to close the hearing on the 1-6 year Street Plan; ayes:  Johnson, Newhouse, Blessing, Lesac; Absent:  Gillott, motion carried.

Motion by Johnson, seconded by Newhouse to adopt Resolution 13-01, adopting the 1-6 Year Street Plan; ayes:  Johnson, Newhouse, Blessing, Lesac; Absent:  Gillott, motion carried. 

Review and approve 2011-2012 Audit Report.  Motion by Blessing, seconded by Johnson to approve the 2011-2012 audit report; ayes:  Johnson, Newhouse, Blessing, Lesac; Absent:  Gillott.

Chairperson Lesac introduced and read by title Ordinance #531 through #535 AN ORDINANCE ADOPTED BY THE VILLAGE OF MURRAY, CASS COUNTY, NEBRASKA #531 Motor Vehicle Fees; #532 – Animals; to clarify definition of “police animal;” to provide that harassment of a police animal is an offense; #533 – Occupation Taxes; to require occupation taxes be levied in accordance with state law requirements; #534 – Alcoholic Beverages; to revise the provisions relating to hours of sale; #535 – General Offenses; to provide that obstruction of a police animal is an offense; to clarify definition of “police animal.” Trustee Blessing  motioned, seconded by Trustee Johnson to suspend the three required statutory readings of Ordinance #531 through #535; ayes:  Johnson, Newhouse, Blessing, Lesac; Absent:  Gillott, motion carried.  Motion by Johnson, seconded by Blessing to adopt, post and publish in pamphlet form Ordinance #531 through #535; ayes:  Johnson, Newhouse, Blessing, Lesac; Absent:  Gillott, motion carried.

Maintenance Report.  Park. Water. Street. Sewer.

Motion by Johnson, seconded by Blessing to open the hearing for Tax Lot 26, an Administrative Subdivision in Cass County, NE, Donette and Scott Koelzer; ayes:  Johnson, Blessing, Gillott, Lesac; Absent:  Newhouse,  motion carried.  Trustee Blessing asked where this was located.  Trustee Johnson explained the location. Trustee Johnson asked if they were subdividing off three acres, Koelzer said yes, they didn’t want to do it but the bank was forcing them to.  Johnson asked why and Koelzer said it had something to do with the farm ground being worth more by itself than the house sitting on it.

Motion by Blessing, seconded by Johnson to close the hearing on Tax Lot 26; ayes:  Johnson, Blessing, Gillott, Lesac; Absent:  Newhouse, motion carried.

Motion by Johnson, seconded by Gillott to approve Tax Lot 26, an Administrative Subdivision; ayes:  Johnson, Blessing, Gillott, Lesac; Absent:  Newhouse, motion carried.

Review 1-6 year Street Plan.  Chairperson Lesac said she did not think there were any changes.  The board agreed.

Open forum.  There were no attendees.
