The Murray, Nebraska Board of Trustees met in regular session on Tuesday, August 13, 2013, at 7:00 pm in the Murray Municipal Building. Present: Trustees: Mike Gillott, George Blessing, Bill Johnson; Absent: Debbie Newhouse, Shelley Lesac; Village Clerk Eileen Murdoch; attending: guests.
Notice of the meeting was given in advance thereof by posting in (3) three public places as shown by the certificate attached to these minutes. Notice of the meeting was simultaneously given to the Chairperson and all members of the Board of Trustees. Their acknowledgement of receipt of notice and agenda is attached to these minutes. All proceedings thereafter were taken while the convened meeting was open to the attendance of the public.
Pro-Tem Johnson called the meeting to order at 7:00 PM and informed the audience of the location of the open meetings act poster.
Motion by Blessing, seconded by Gillott to approve the minutes of the July 9, 2013, regular meeting; ayes: Johnson, Blessing, Gillott; Absent: Newhouse, Lesac; motion carried.
Motion by Blessing, seconded by Gillott to acknowledge receipt of the Treasurer's report; ayes: Johnson, Blessing, Gillott; Absent: Newhouse, Lesac; motion carried.
Motion by Gillott, seconded by Blessing to approve claims as revised; ayes: Johnson, Blessing, Gillott; Absent: Newhouse, Lesac; motion carried.
Maintenance Report.
Adopt Exhibit A, NDOR ADA Policy Statement. Motion by Blessing, seconded by Gillott to adopt Exhibit "A" to the ADA Policy Statement; ayes: Johnson, Blessing, Gillott; Absent: Newhouse, Lesac, motion carried.
Discuss bidding trash contract. Motion by Blessing, seconded by Gillott to bid Murray's trash contract; ayes: Johnson, Blessing, Gillott; Absent: Newhouse, Lesac; motion carried.
Review street proposal. Motion by Blessing, seconded by Gillott to approve the street work for $26,619.50; ayes: Johnson, Blessing, Gillott; Absent: Newhouse, Lesac, motion carried.
Hilda Resso, 4th of July Committee request to use Young Park for 2014 4th of July celebration. Motion by Blessing seconded by Gillott to approve use of Young Park for the 2014 4th of July celebration; ayes: Johnson, Blessing, Gillott; Absent: Newhouse, Lesac, motion carried.
Discuss Cass County Going Green Statement of Commitment. Motion by Blessing, seconded by Johnson to support the Cass County recycling program if they re-word the commitment letter to be geared toward the town and not the individual; ayes: Johnson, Blessing, Gillott; Absent: Newhouse, Lesac, motion carried.
Safety Committee meeting.
Motion by Blessing, seconded by Gillott to adjourn the meeting at 7:30 PM; ayes: Johnson, Blessing, Gillott; Absent: Newhouse, Lesac; motion carried.

James and Rita Parriott, request to revoke or revise ordinance on prohibiting fowl in town limits.
Trailer court nuisance status update. Motion by Newhouse, seconded by Johnson to send Berner a letter to board one trailer up within 14 days and to dispose of the other in another 15 days; ayes: Johnson, Newhouse, Blessing, Lesac; Absent: Gillott, motion carried.
Windstream request to bury cable in public right-of-way. Motion by Newhouse, seconded by Johnson to approve the request to bury cable in public right-of-way; ayes: Johnson, Newhouse, Blessing, Lesac; Absent: Gillott, motion carried.
Approve block off of Campbell St from Davis Ave to Park for Hobscheidt Auction on June 29th, 2013. Chairperson Lesac introduced and read by title Ordinance #536 AN ORDINANCE AMENDING CHAPTER 94, SECTION 94.07 OF TITLE IX OF THE CODE OF ORDINANCES OF THE VILLAGE OF MURRAY, NEBRASKA; TO PROVIDE FOR THE REPEAL OF CONFLICTING ORDINANCES OR SECTIONS; AND TO PROVIDE FOR AN EFFECTIVE DATE – Section 94.07 of Chapter 94, entitled "Fowl Prohibited" is amended." Trustee Johnson motioned seconded by Trustee Newhouse to suspend the three required statutory readings of Ordinance #536; ayes: Johnson, Newhouse, Blessing, Gillott, Lesac; motion carried. Motion by Johnson, seconded by Newhouse to adopt, post and publish in pamphlet form Ordinance #536; ayes: Johnson, Newhouse, Blessing, Gillott, Lesac; motion carried.
Adopt Village of Murray Policy Statement Section 502 – Rehabilitation Act of 1973, Americans with Disabilities Act of 1990. Motion by Newhouse, seconded by Johnson to adopt the Village of Murray Policy Statement Section 502; ayes: Johnson, Newhouse, Blessing, Gillott, Lesac; motion carried.
