VILLAGE OF MURRAY, NEBRASKA

The Murray, Nebraska Board of Trustees met in regular session on Tuesday, August 14, 2012 at 7:00 pm in the Murray Municipal Building.  Present:  Trustees: Bill Johnson, George Blessing, Shelley Lesac; Absent: Debbie Newhouse, Mike Gillott; Village Clerk Eileen Murdoch; attending: guests.

Notice of the meeting was given in advance thereof by posting in (3) three public places as shown by the certificate attached to these minutes.  Notice of the meeting was simultaneously given to the Chairperson and all members of the Board of Trustees.  Their acknowledgement of receipt of notice and agenda is attached to these minutes.  All proceedings thereafter were taken while the convened meeting was open to the attendance of the public.

Chairperson Lesac called the meeting to order at 7:04 PM and informed the audience of the location of the open meetings act poster.

Motion by Johnson seconded by Blessing to approve the minutes of the July 10, 2012, regular meeting; ayes:  Johnson, Blessing, Lesac; Absent: Newhouse, Gillott, motion carried.

Motion by Blessing, seconded by Johnson to acknowledge receipt of the Treasurer’s report; ayes: Johnson, Blessing, Lesac; Absent:  Newhouse, Gillott,motion carried.

Motion by Johnson, seconded by Blessing to approve claims as revised; ayes:  Johnson, Blessing, Lesac; Absent:  Newhouse, Gillott, motion carried.

Resolution 12-05 to sign agreement with Nebraska Department of Roads on Flashing Beacon installation.  Motion by Johnson, seconded by Blessing to pass Resolution 12.05, ayes:  Johnson, Blessing, Lesac; Absent:  Newhouse, Gillott, motion carried.

Motion by Johnson, seconded by Blessing to sign the agreement with the Nebraska Department of Roads Flashing Beacon Installation; ayes:  Johnson, Blessing, Lesac; Absent:  Newhouse, Gillott, motion carried.

Motion by Blessing, seconded by Johnson to approve the membership fees to SENDD in the amount of $394 and housing dues of $139; ayes:  Johnson, Blessing, Lesac; Absent:  Motion carried.

Maintenance Report. Trustee Newhouse entered the meeting at 7:15 PM.

Motion by Johnson, seconded by Blessing to adjourn the meeting at7:31 PM; ayes:  Johnson, Newhouse, Blessing, Lesac; Absent:  Gillott, motion carried.

Maintenance Report. 

Robert Wagner, Mike Sawyer discuss possible 2nd infield for Young Memorial Park.  Motion by Blessing, seconded by Gillott to allow the softball/baseball clubs to put in a second infield at the Young Park ball field; ayes:  Johnson, Blessing, Gillott; Abstain:  Newhouse, Lesac, motion carried.

Discuss liability, insurance, other issues with storage building/batting cages (on tennis courts) for ball club

Resolution 12-04 Election to impose a Sales and Use Tax (language amended).  Resolution 12-04, A RESOLUTION PROVIDING FOR THE REVOCATION OF RESOLUTION 12-03 PASSED AND APPROVED BY THE VILLAGE BOARD OF TRUSTEES ON APRIL 10, 2012, AND PROVIDING FOR AN ELECTION PURSUANT TO NEBRASKA REVISED STATUTE SS 77-27, 142.01 AND 142.02 TO IMPOSE A SALES AND USE TAX UPON THE SAME TRANSACTION WITHIN THE VILLAGE, ON WHICH THE STATE OF NEBRASKA IS AUTHORIZED TO IMPOSE A TAX PURSUANT TO THE NEBRASKA REVENUE ACT OF 1967, AS AMENDED TO BE EFFECTIVE APRIL 1, 2013.  THE SALES AND USE TAX IMPOSED HEREIN SHALL NOT HAVE A SUNSET DATE.  Motion by Newhouse, seconded by Blessing to adopt Resolution 12-04; ayes:  Johnson, Newhouse, Blessing, Gillott, Lesac; motion carried.

Discuss amending deposit ordinance for rental properties

Motion by Johnson, seconded by Newhouse to adjourn the meeting at 8:03 PM; ayes:  Johnson, Newhouse, Blessing, Gillott, Lesac; motion carried.

Hilda Resso, 4th of July Committee request use of Young Park for the 4th of July celebration.  Motion by Blessing, seconded by Gillott to approve use ofYoung Park for the 4th of July celebration; ayes:  Johnson, Newhouse, Blessing, Gillott; Absent:  Lesac, motion carried.

Steve Harris, discuss sewer fees.  Harris was not in attendance.
