The Murray, Nebraska Board of Trustees met in regular session on Tuesday, July 11, 2017, at 7:00 pm in the Murray Municipal Building. Present: Trustees: Mike Gillott, Brian Coffman, Stan Flak, Alan Miller, Absent: George Blessing; Village Clerk Eileen Murdoch; attending: guests.

Notice of the meeting was given in advance thereof by posting in (3) three public places as shown by the certificate attached to these minutes. Notice of the meeting was simultaneously given to the Chairman and all members of the Board of Trustees. Their acknowledgement of receipt of notice and agenda is attached to these minutes. All proceedings thereafter were taken while the convened meeting was open to the attendance of the public.
Chairman Gillott called the meeting to order at 7:00 PM and informed the audience of the location of the open meetings act poster.

Motion by Coffman, seconded by Flak to approve the minutes of the June 13, 2017 regular meeting, ayes: Gillott, Coffman, Flak, Miller; Absent: Blessing, motion carried.

Motion by Flak, seconded by Miller to acknowledge receipt of the Treasurer’s report; ayes: Gillott, Coffman, Flak, Miller; Absent: Blessing, motion carried.

Claims approval. Motion by Flak, seconded by Coffman to approve claims as revised; ayes: Gillott, Coffman, Flak, Miller; Absent: Blessing, motion carried.

Maintenance Report. Trustee Blessing entered the meeting at 7:07 PM.

Hearing on the rezoning of Tritsch’s 1st, Lots 3 and 4 and Fairview Acres Outlot Park Area from residential to commercial. Motion by Coffman, seconded by Blessing to open the hearing at 7:15 PM for the rezoning, ayes: Gillott, Coffman, Flak, Blessing, Miller; motion carried.

Motion by Miller, seconded by Coffman to close the hearing at 8:00 PM; ayes: Gillott, Coffman, Flak, Blessing, Miller; motion carried.

Motion by Blessing to table the issue, motion died for lack of a second.

Motion by Miller, seconded by Flak to rezone the two parcels of VanWinkle’s to commercial and then the 3rd parcel to commercial after it has been subdivided leaving the other half of it residential depending on how the new plot line is; ayes: Gillott, Coffman, Flak, Blessing, Miller; motion carried.
Jeff Andersen, discuss speed limits/traffic, Main Street.

Discuss 109 N. Loughridge possible nuisance or possible no parking discussion.

Motion by Coffman, seconded by Flak to declare 109 N. Loughridge a nuisance depending on the attorney’s recommendation; ayes: Gillott, Coffman, Flak, Blessing, Miller, motion carried.

Discuss LARM Renewal; options, if approved, Adopt Resolution 17-04.

Discuss action on trailer court nuisance, Berner, 811 Main Street.

Motion by Blessing, seconded by Miller, if we get permission legally to dispose of the building, that Coffman is approved to go ahead with the asbestos inspection and we are willing after the training to pay for the clean-up; ayes: Gillott, Coffman, Flak, Blessing, Miller, motion carried.

Main Street beautification project.

Motion by Miller, seconded by Coffman to form a Beautification Committee with Trustee Coffman heading it up; ayes: Gillott, Coffman, Flak, Blessing, Miller, motion carried.

Discuss findings and possibility of offering auto payments through Cornerstone Bank.

Motion by Coffman, seconded by Blessing to adjourn the meeting at 9:07 PM; ayes: Gillott, Coffman, Flak, Blessing, Miller, motion carried.

Motion by Coffman, seconded by Blessing to accept the bid from Jack Gorton to put top caps on memorial wall for $150; ayes: Gillott, Coffman, Flak, Blessing, Miller, motion carried.

Jeff and Kylie Anderson, request to have chickens at 103 West Main Street. Motion by Miller, seconded by Coffman to grant permission to the Andersen’s to have chickens at 103 West Main Street; ayes: Gillott, Coffman, Flak, Blessing, Miller, motion carried.

Whitney Van Winkle, discussion and requests regarding parcels 130039209, 130039217 and 130154083.

Chairman Gillott introduced and read by title Ordinance #583 AN ORDINANCE ADOPTED BY THE VILLAGE OF MURRAY, CASS COUNTY, NEBRASKA #583, an Ordinance reducing the speed limits at various points in and around the Village of Murray. Trustee Flak motioned, seconded by Trustee Miller to suspend the three required statutory readings of Ordinance #583, ayes: Gillott, Coffman, Flak, Blessing, Miller; motion carried. Motion by Coffman, seconded by Flak to adopt, post and publish in pamphlet form Ordinance #583; ayes: Gillott, Coffman, Flak, Blessing, Miller; motion carried.

Resolution 17-03 Sell Excess Equipment. Trustee Miller said this is through Big Iron, they are going to take pictures of the equipment, there is no reserve on anything. Motion by Coffman, seconded by Flak to adopt Resolution 17-03, Sell Excess Equipment as listed to include drill press and snow plow, ayes: Gillott, Coffman, Flak, Blessing, Miller, motion carried.

Discuss two options for cameras for tree/leaf/limb dump site, pole cost findings. Motion by Coffman, seconded by Flak to approve the purchase of a camera system for the leaf/limb/tree dump site for $4,450.00 and an estimated cost of $400 for parts, not to exceed $5,000; ayes: Gillott, Coffman, Flak, Blessing, Miller, motion carried.

Discuss action on trailer court nuisance, Berner 811 Main Street. Motion by Coffman, seconded by Blessing to board up the trailer and make it safe and send a bill to the owner; ayes: Gillott, Coffman, Flak, Blessing, Miller, motion carried.

Discuss findings and recommendations from Village computer clean-up.

Maintenance Report.

Cornerstone Bank, variance request; approve building permit, Rock Bluff Road. Motion by Miller, seconded by Coffman to approve the variance request and building permit for Cornerstond Bank; ayes: Gillott, Coffman, Flak, Blessing, Miller, motion carried.

Jonas and Maureen Totilas, 10683 12th Street, building permit for pole building. Motion by Coffman, seconded by Miller to approve the building permit for 10683 12th Street; Ayes: Gillott, Coffman, Flak, Blessing, Miller, motion carried.

Brian Miner, request for Special Designated Liquor License for 4th of July celebration, Young Park. Miner was not in attendance.

Tim Williams proposal for memorial bricks at park. Motion by Blessing, seconded by Coffman to approve Williams bid and what had been discussed at this meeting, to put the blocks on the memorial wall; ayes: Gillott, Coffman, Flak, Blessing, Miller, motion carried.

Albert and Sherrill Konfrst, discuss pay for unused vacation time. Konfrst’s were not in attendance.
Review and discuss items for auction on Big Iron.

Review work at Tyson Park restroom, set budget at $10,000. Motion by Blessing, seconded by Flak to set the budget at $10,000 with a 10% overage for the improvements to the Tyson Park bathroom; ayes: Gillott, Flak, Blessing; nays: Coffman, Miller, motion carried.

Review bid for Town Hall renovations/repairs; approve. Motion by Flak, seconded by Coffman that if the insurance company will pay the claim then we accept the bid for the work on town hall; ayes: Gillott, Coffman, Flak, Miller; nays: Blessing, motion carried.

Review/discuss camera options for the tree/limb/leaf dump site; action if any. Discuss/review bid and plan for Murray Clean-up Day; select vendor clean-up day. Motion by Blessing seconded by Coffman to schedule the clean-up day for May 27th from 8-2 and use Can-it to provide 2 dumpsters; the discussion turned to where the location would be for the clean-up; it was decided to locate at town hall; ayes: Gillott, Coffman, Flak, Blessing, Miller, motion carried. There was discussion on how to communicate the clean-up day and the hours.

Discuss nuisance abatement procedures; recuperating costs.

Review/discuss bid for cleaning town hall once a month from It’s Your Call. Motion by Miller, seconded by Coffman to have It’s Your Call clean town hall twice a month at $45 or a little more since he’s not doing it weekly; ayes: Gillott, Coffman, Flak, Blessing, Miller, motion carried.

Executive Session to discuss personnel matters. Motion by Blessing seconded by Coffman to enter executive session at 9:23 PM; ayes: Gillott, Coffman, Flak, Blessing, Miller, motion carried.

Motion by Blessing, seconded by Coffman to exit executive session at 9:57PM; ayes; Gillott, Coffman, Flak, Blessing, Miller, motion carried.
