The Murray, Nebraska Board of Trustees met in regular session on Tuesday, October 11, 2016, at 7:00 pm in the Murray Municipal Building. Present: Trustees: Bill Johnson, Mike Gillott, Stan Flak, Alan Miller; Absent: George Blessing; Village Clerk Eileen Murdoch; attending: guests.
Notice of the meeting was given in advance thereof by posting in (3) three public places as shown by the certificate attached to these minutes. Notice of the meeting was simultaneously given to the Chairman and all members of the Board of Trustees. Their acknowledgement of receipt of notice and agenda is attached to these minutes. All proceedings thereafter were taken while the convened meeting was open to the attendance of the public.
Chairman Johnson called the meeting to order at 7:00 PM and informed the audience of the location of the open meetings act poster.
Motion by Flak, seconded by Gillott to approve the minutes of the September 13, 2016 regular meeting; ayes: Johnson, Gillott, Flak, Miller; Absent: Blessing, motion carried.
Motion by Flak, seconded by Gillott to acknowledge receipt of the Treasurer’s report; ayes: Johnson, Gillott, Flak, Miller; Absent: Blessing, motion carried.
Motion by Miller, seconded by Gillott to approve claims as revised; ayes: Johnson, Gillott, Flak, Miller; Absent: Blessing, motion carried.
Maintenance Report. Park. Trustee Flak said we need to officially note that the Murray Rural Fire District donated their old flag pole to the Village, they were replacing theirs and they donated the old one to the village. Water. Streets. Sewer.
Trista Farrens, Cass County Economic Council.
Josh Guenthner, request for reimbursement on Taylor Street overlay (north end). Motion by Flak, seconded by Gillott to reimburse Josh Guenthner $1,400 to have a portion of Taylor Street overlaid; ayes: Johnson, Gillott, Flak; Nays: Miller; Absent: Blessing, motion carried.
Russ Heins, discuss placement of stop sign on SE corner of Park Ave and Campbell Street.
Gene Noell, discuss payment of bill of $612.80 from Kerns Excavating for repair of broken curb stop at 304 N. Denise Ave. Motion by Gillott, seconded by Miller to deny the claim of Noell for the Kerns bill of $612.80; ayes: Johnson, Gillott, Flak, Miller; Absent: Blessing, motion carried.
Transfer $18,351.33 from general fund to park fund to zero out. Motion by Miller, seconded by Gillott to transfer $18,351.33 from the general fund to the park fund to zero out; ayes: Johnson, Gillott, Flak, Miller; Absent: Blessing, motion carried.
Open Forum. There was general discussion on a report on the water tower.

Chairman Johnson introduced and read by title Ordinance #572 AN ORDINANCE ADOPTED BY THE VILLAGE OF MURRAY, CASS COUNTY, NEBRASKA TO ADOPT THE BUDGET STATEMENT TO BE TERMED THE ANNUAL APPROPRIATION BILL; TO APPROPRIATE SUMS FOR NECESSARY EXPENSES AND LIABILITIES; TO PROVIDE FOR AN EFFECTIVE DATE. Motion by Flak, seconded by Blessing to suspend the three required statutory readings of Ordinance #572; ayes: Johnson, Blessing, Gillott, Flak, Miller; motion carried. Motion by Miller, seconded by Gillott to adopt, post and publish in pamphlet form Ordinance #572; ayes: Johnson, Blessing, Gillott, Flak, Miller; motion carried.

Motion by Blessing, seconded by Gillott to approve the 1% restricted fund increase; ayes: Johnson, Blessing, Gillott, Flak, Miller; motion carried.
Motion by Blessing seconded by Gillott to adopt Resolution #16-06 Set the Property Tax Levy; ayes: Johnson, Blessing, Gillott, Flak, Miller; motion carried.
Murray Rural Fire Department, building permit for building addition. Motion by Blessing, seconded by Miller to approve the building permit for the Murray Rural Fire District; ayes: Blessing Miller, Flak said he would vote yes, however, someone there should have known they needed a permit before they started this, and we did not issue the permit, unfortunately in researching this we have no penalty we can assess, it’s not the way to do business, but he voted yes.; Nays: Johnson, Gillott; motion carried.
Jon Rowe, 8246 Oddo Circle, building permit for pole building. Motion by Blessing, seconded by Flak to approve the building permit for a pole building at 8246 Oddo Circle; ayes: Johnson Blessing, Gillott, Flak, Miller; motion carried.
Timothy Maine, requesting permission to have horses at 713 E. Main St. Motion by Miller, seconded by Gillott to allow Maines to have animals at 713 E. Main with a non-conforming use agreement; ayes: Johnson, Blessing, Gillott, Flak, Miller; motion carried.
Conestoga School request to put sign up at Young Park ballfield. Motion by Miller, seconded by Gillott to approve the school put up a sign at the Young park ballfield; ayes: Johnson, Blessing, Gillott, Flak, Miller; motion carried.

Kyle, Grant and Wesley Nickels, Tyson Park Eagle Scout project. Motion by Blessing, seconded by Gillott to approve the Nickels boys Eagle Scout projects at Tyson Park; ayes: Johnson, Blessing, Gillott, Flak, Miller; motion carried.
Adopt Resolution 16-04, Minimum Water Rates. Chairman Johnson read the Resolution to the board and attending guests. Motion by Blessing, seconded by Gillott to adopt Resolution 16-04; ayes: Johnson, Blessing, Gillott, Flak, Miller; motion carried.
AN ORDINANCE ADOPTED BY THE VILLAGE OF MURRAY, CASS COUNTY, NEBRASKA, Chairman Johnson introduced and read by title Ordinance #571 – Relating to all terrain and utility vehicles, to allow the operation of all terrain and utility vehicles within the corporate limits under certain circumstances; Trustee Flak motioned, seconded by Trustee Blessing to suspend the three required readings of Ordinance #571; ayes: Johnson, Blessing, Gillott, Flak, Miller; motion carried. Trustee Flak motioned, seconded by Trustee Blessing Flak to adopt, post and publish in pamphlet form Ordinance #571; ayes: Johnson, Blessing, Gillott, Flak, Miller; motion carried.
Review LARM renewal, select term and adopt resolution 16-05, if approved. Motion by Flak, seconded by Blessing to accept the 3 year term, 5% discount; ayes: Johnson, Blessing, Gillott, Flak, Miller; motion carried.
Motion by Blessing, seconded by Gillott to enter executive session at 7:58 PM to discuss personnel matters; ayes: Johnson, Blessing, Gillott, Flak, Miller; motion carried. Discuss possible contract with Plattsmouth animal control for dog/cat control.
Trustee Blessing brought a nuisance issue to the attention of the board.
