The Murray, Nebraska Board of Trustees met in regular session on Tuesday, February 9, 2016, at 7:00 pm in the Murray Municipal Building. Present: Trustees: Bill Johnson, George Blessing, Stan Flak, Mike Gillott; Village Clerk Eileen Murdoch; attending: guests.
Notice of the meeting was given in advance thereof by posting in (3) three public places as shown by the certificate attached to these minutes. Notice of the meeting was simultaneously given to the Chairman and all members of the Board of Trustees. Their acknowledgement of receipt of notice and agenda is attached to these minutes. All proceedings thereafter were taken while the convened meeting was open to the attendance of the public.

Chairman Johnson called the meeting to order at 7:00 PM and informed the audience of the location of the open meetings act poster.

Motion by Flak, seconded by Gillott to approve the minutes of the January 12, 2016 regular meeting; ayes: Johnson, Gillott, Flak; Absent: Blessing, motion carried.

Motion by Flak, seconded by Gillott to acknowledge receipt of the Treasurer’s report; ayes: Johnson, Gillott, Flak; Absent: Blessing, motion carried.

Motion by Flak, seconded by Gillott to approve claims as revised; ayes: Johnson, Gillott, Flak; Absent: Blessing, motion carried.

Maintenance Report.

Trustee Blessing entered the meeting at 7:08 PM.

Hearing for 1-6 year street plan. Motion by Blessing, seconded by Flak to open the hearing at 7:10 PM for the 1-6 year street plan. Motion by Blessing seconded by Gillott to close the 1-6 year street hearing; ayes: Johnson, Blessing, Gillott, Flak; motion carried.

Motion by Flak seconded by Blessing to adopt Resolution 16-01, 1-6 Year Street Plan; ayes: Johnson, Blessing, Gillott, Flak; motion carried.

Jack Vasa, JEO, review and approve proposed Campbell Street drainage project; scope of services. Motion by Flak, seconded by Blessing to proceed with JEO and the Campbell Street Drainage Improvements; ayes: Johnson, Blessing, Gillott, Flak; motion carried.

Chairman Johnson introduced and read by title Ordinance #558 through #562 AN ORDINANCE ADOPTED BY THE VILLAGE OF MURRAY, CASS COUNTY, NEBRASKA #558 - Dead or Diseased Trees; #559 – Regulation of Snow, Ice and Other Encroachments; #560 – Regulation of Obstructions; #561 – General Powers – One Mile Zoning; #562 – Vacancy – General Provisions. Trustee Blessing motioned, seconded by Trustee Flak to suspend the three required statutory readings of Ordinance #558 through #562; ayes: Johnson, Blessing, Gillott, Flak; motion carried. Motion by Blessing, seconded by Flak to adopt, post and publish in pamphlet form Ordinance #558 through #562; ayes: Johnson, Blessing, Gillott, Flak; motion carried.

Review applications for Trustee opening. Motion by Blessing, seconded by Gillott to appoint Alan Miller to complete Debbie Newhouse’s term as a Board of Trustee; ayes: Johnson, Blessing, Gillott, Flak; motion carried.

Motion by Blessing seconded by Gillott to adjourn the meeting at 7:23 PM; ayes: Johnson, Blessing, Gillott, Flak; motion carried.

Motion by Newhouse, seconded by Flak to approve the change order, the payment request and the Certificate of Substantial Completion for the Latta St. drainage project, ayes: Johnson, Newhouse, Blessing, Gillott, Flak, motion carried.

Motion by Blessing, seconded by Newhouse to request a proposal from JEO for the participation of the NRD in the Campbell Street drainage project; ayes: Johnson, Newhouse, Blessing, Gillott, Flak, motion carried.

Motion by Blessing, seconded by Newhouse to enter executive session at 7:27 PM to discuss personnel issues; ayes: Johnson, Newhouse, Blessing, Gillott, Flak, motion carried. Motion by Blessing, seconded by Flak to exit Executive session at 8:07 PM, ayes: Johnson, Newhouse, Blessing, Gillott, Flak, motion carried,

Pro- Tem Newhouse called the reorganization of the board to order at 8:08 PM. Motion by Blessing, seconded by Gillott to nominate Bill Johnson for Chairperson; there were no other nominations, Pro Tem Newhouse closed nominations. Ayes for Bill Johnson as Chairman, Newhouse, Blessing, Gillott, Flak; Abstain: Johnson, motion carried. Johnson opened nominations for Pro Tem, Johnson nominated Stan Flak, Newhouse seconded the nomination, there were no further nominations. Ayes for Stan Flak as Pro Tem; Johnson, Newhouse, Blessing, Gillott; Abstain: Flak, motion carried.
